Event: PLI's Fundamentals of Copyright Law in the Data Era

We're honored to have been invited to speak at PLI's "Fundamentals of Copyright Law in the Data Era." Executive Director Art Neill and Assistant Director Shaun Spalding will be at the Practising Law Institute in San Francisco on July 9th, 2018, presenting during the capstone panel of the day.

They'll be talking about "embedding liability," "the future of 'the server test'" and other topics that will surely be riviting to other Copyright attorneys! The big question: will blogs be able to continue to legally embed tweets, youtube videos, and Instagram posts in the future?

Arts and IP Volunteer Lawyer Organizations

As we've written about before there's a major justice gap when it comes to creators and entrepreneurs having access to critical legal services. While we do our best to provide free and low cost legal services, we’re only one organization. We’ve put together this national list of Arts and IP Volunteer Lawyer Organizations as a resource to creators, entrepreneurs, and even other lawyers to help find other legal organizations fighting to fill the justice gap.

This list only has volunteer lawyer groups, legal aide organizations, and other non-law school related associations or organizations. These types of organizations are typically comprised of licensed attorneys who volunteer on a free or low cost basis to assist members of the public in certain areas of the law if they meet certain income qualifications. 

Another great option to find pro bono or low cost services is to reach out to a law school clinic. Clinics will provide legal services through law students overseen by experienced practitioners. Visit our separate list of Law School IP and Entrepreneurship Clinics

While we do not have the experience to vouch for these sources and do not endorse any of these organizations; we hope that this list serves as a helpful starting point.

New Media Rights Joins the EFF and OTW in Latest Supplemental Filing on §1201 Anti-circumvention Exemptions

On June 11, 2018, New Media Rights joined the Electronic Frontier Foundation and the Organization for Transformative Works in filing a response to questions that the Copyright Office posed after we testified at the §1201 Anti-Circumvention hearings in April.

The Copyright Office inquired as to whether screen capture is an alternative to circumvention for educational uses of short film clips outside of the context of film studies courses. Our joint response reinforces our position that screen capture is not a sufficient alternative to circumvention for fair use of short clips of video.

Section 1201 outlines the DMCA’s anti-circumvention provisions that make it illegal to bypass technological protection measures (TPMs) (also known as Digital Rights Management (DRM)) that restrict access to copyrighted content. However, if the reason for breaking encryption on the content falls under an exemption to the statute, then the circumventor is relieved of liability for breaking the encryption.

Sara, a former Orange County Register journalist, is excited to work with New Media Rights during her final year at California Western School of Law. She is also Editor-in-Chief of The Commentary, California Western’s online student-run newspaper, and a member of the California Western Law Review.

Her intellectual property experience includes interning with California Western’s Trademark Clinic and competing in the 2017 Saul Lefkowitz Moot Court competition, hosted by the International Trademark Association. Her legal article on the tort and intellectual property implications of Pokemon Go is published in the Whittier Law Review.

Brittany is a native of Southern California and has lived in San Diego for over 18 years. She earned her Bachelor of Arts from the University of California San Diego, where she majored in History and minored in Linguistics. She later successfully completed the University of California San Diego-Extension school’s ABA-approved Accelerated Paralegal Certification Program and was inducted into the prestigious Lambda Epsilon Chi honor society. Prior to attending law school, Brittany served as a Boatswain’s Mate in the United States Coast Guard for four years. After being stationed in New Jersey, Puerto Rico, Virginia, and Alaska, Brittany began her studies at California Western School of Law. This is Brittany's third semester interning at New Media Rights. She has also interned at the San Diego intellectual property and business law firm Wilkinson Mazzeo as well as the copyright and trademark litigation firm US IP Attorneys. Through her internships, she has gained experience in copyright law, trademark law, small business law, and privacy law. She is interested in practicing in the area of Entertainment Law and is passionate about helping filmmakers, authors, and creators protect their creations in an ethical, efficient, and competent manner.
